Terms of service

Last updated: October 31, 2026

These terms govern your use of PeerWay. By creating an account or using the service, you accept these terms and the privacy policy. If you do not agree, do not use the service. PeerWay is in a free beta; no paid plans are available.

Operator and scope

PeerWay is operated by Javier Eduardo Berrezueta Varas, an individual operator established in Ecuador. These terms apply to www.peerway.me, the desktop app and the account, cloud and P2P transfer services. The privacy policy forms part of these terms. If a paid plan is offered in the future, the relevant offer will include additional terms.

Age and accounts

You must be at least 16 to create an account or use features that require an account. You must keep your password, permanent code and devices confidential. We do not currently offer email-based password recovery. If you sign in on another device, the permanent code is reassigned to the new identity and previous access may stop working. If you lose your credentials or code, we may not be able to recover your account or files. You are responsible for activity carried out with your credentials.

The service

PeerWay lets you send files between devices using a connection code. P2P transfers use end-to-end encryption, although the relay may carry the encrypted bytes. Cloud storage is optional: in the free beta it includes 5 GB in total, and each file is deleted 30 days after upload. The cloud is not end-to-end encrypted, and the operator or storage provider can technically access its content. Pro and Team plans are not available.

Free beta and no payments

The service is currently provided free of charge and in beta. There are no paid plans, prices, annual billing, automatic renewal, subscription cancellation, priority support or payment flow available. PayPal is disabled. You cannot buy Pro or Team. If we offer paid plans in the future, we will publish an updated offer and terms before accepting payments. As a policy intention for those future plans, we intend to offer a voluntary full refund if requested within 30 days of purchase; that policy is not in force today because no plan can be purchased, and it does not affect any rights you have under the law. In Ecuador, the statutory withdrawal period is at least 15 days from receipt of the service (LODC Art. 45); the voluntary 30-day policy will be in addition to that right and will not limit it.

Your content and the licence you grant us

You keep ownership of the files and content you send, receive or store. We do not acquire ownership of your content. To operate cloud storage and the features you request, you grant us a worldwide, non-exclusive, royalty-free, limited licence to host, reproduce, transmit and process your content only as necessary to provide the service. This licence ends when you delete the content or your account, except for copies we must keep temporarily for technical, security or legal reasons. We do not store P2P content; the relay only carries encrypted bytes.

Acceptable use

You may not use PeerWay to: (a) distribute illegal content, child sexual abuse material (CSAM), non-consensual intimate imagery (NCII), malware or content that infringes intellectual property rights; (b) harass, threaten, defraud or violate the rights of others; (c) evade sanctions, export controls or legal restrictions; (d) attempt to access accounts, devices, servers or networks without authorisation; (e) interfere with the service, introduce malicious code or carry out attacks; or (f) send spam or unsolicited communications. We may investigate reports and suspend or terminate accounts, remove cloud content or block access when necessary to comply with the law or protect the service, users or third parties. We do not generally monitor encrypted P2P content; we will act on reports or legal requests to the extent technically possible.

Availability and service changes

PeerWay is a free beta and does not offer a guaranteed service level (SLA). P2P depends on the network and the devices of the parties. We do not guarantee that a direct connection will always be possible; the relay is a last-resort mechanism and may add latency or limits. Cloud storage may have limits on space, file size, retention and availability. We may modify, suspend or withdraw features, or perform maintenance, with reasonable notice where possible. If a material change adversely affects your rights, the changes section applies.

Privacy, security and cloud access

The privacy policy explains what data we process. P2P transfers are end-to-end encrypted, but the coordination server and relay see technical metadata, and anyone who knows a code while the device is online can query some pairing data. The cloud is not end-to-end encrypted: the operator and the storage provider can technically access its content. You must protect your codes, passwords, keys and devices, and keep backups of important files.

Your responsibilities and backups

You are responsible for the content you send, receive or store and for the consequences of using it. You must have the necessary rights to the content you share. Keep backups of important files: free cloud deletes each file after 30 days, and loss of credentials, local deletion or an interruption may prevent access. Do not use PeerWay as your only backup.

Warranty

We provide the service with the reasonable care expected of a free beta, but we do not guarantee that it will be uninterrupted, error-free, secure in every environment or fit for a particular purpose. We do not guarantee that files will be kept beyond the stated periods or that accounts or codes can be recovered. These limitations apply to the extent permitted by law and without prejudice to mandatory rights you have as a consumer.

Limitation of liability

To the maximum extent permitted by applicable law, and without prejudice to your mandatory rights, we are not liable for indirect, incidental, special or punitive damages, loss of profits, loss of business, loss of data or interruptions arising from your use of or inability to use the service. Nothing in these terms excludes or limits liability for wilful misconduct, gross negligence, fraud, death or personal injury, or any liability that cannot legally be excluded or limited. Nothing in this section limits liability for direct damages that applicable law does not allow to be limited. If applicable law does not allow a limitation, it applies only to the extent permitted.

Suspension and termination

You may stop using the service and request deletion of your account at any time by writing to the contact addresses. We may suspend or terminate your access if you breach these terms, if necessary for security or to comply with the law, or if the service is discontinued. Where possible, we will notify you before or after the measure and explain the reason. You may appeal a suspension or termination by writing to privacidad@peerway.me or privacy@peerway.me; we will review the decision in good faith. Termination does not remove obligations that by their nature survive, such as content, intellectual property, liability or governing law. When the service ends, you may lose your permanent code and cloud files; we do not guarantee recovery.

Intellectual property and copyright notices

We respect intellectual property rights. If you believe content stored in the cloud infringes your rights, send a notice to privacidad@peerway.me (Spanish) or privacy@peerway.me (English) with: (a) identification of the work or right affected; (b) identification of the content and its location (for example, file name, account or link); (c) your contact details; (d) a good-faith statement that the use is not authorised; (e) a statement that the information is accurate and that you are authorised to act; and (f) your physical or electronic signature. We may request additional information, remove or block content and take action against repeat infringers. If you believe a removal was mistaken, you may send us an explanation with the same contact details for review. False or abusive notices may have legal consequences. Because P2P transfers are encrypted, our ability to review directly transferred content is limited; notices apply mainly to cloud content and accounts.

Changes to these terms

We may update these terms to reflect changes in the service, the law or our practices. We will publish the current version with a new date. Material changes will be notified with reasonable advance notice through the website or app. We will not apply deemed acceptance to material changes: where the law requires it, we will ask for your express acceptance, and if you do not accept you may stop using the service and request account deletion. Non-material changes may take effect when published. No change will apply retroactively without a legal basis.

Security, incidents and law-enforcement requests

To report a vulnerability or security incident, write to privacidad@peerway.me or privacy@peerway.me. We will notify security breaches as required by applicable law. Requests from authorities should be sent to the same addresses and include the legal basis and scope; we will review and respond according to the law. We may retain and disclose data when necessary to comply with a legal obligation, protect rights or safety, or respond to a valid request.

Governing law and disputes

These terms are governed by the laws of Ecuador. Nothing in this section limits mandatory rights you have as a consumer or your right to go to the competent courts or consumer authorities in your domicile where the law allows. For disputes not subject to mandatory rules, the courts of Ecuador will have jurisdiction.

Notices

Notices about these terms will be published on the website or in the app. For legal, privacy, security or copyright matters, write to privacidad@peerway.me (Spanish) or privacy@peerway.me (English). The Spanish mailbox is the main channel; the English alias is pending configuration and monitoring. If a message to the English alias fails, use the Spanish mailbox. Notices you send to those addresses are considered received when we receive them.

Assignment, severability and entire agreement

You may not assign these terms without our consent. We may assign them to a successor or purchaser of the service, with notice on the website or in the app. If a clause is held invalid, the remaining clauses will continue in effect and the invalid clause will be interpreted to the extent permitted. These terms, together with the privacy policy and any applicable specific offer, are the entire agreement about the service. The Spanish version prevails over the English translation; the English version is provided for convenience.
